Terms and Conditions

These Terms govern your use of the HIXIUS websites, customer dashboard, and software, and every purchase of our two products: HIXIUS (the original Expert Advisor, sold by subscription) and HIXIUS GOLD (the challenge-passing Expert Advisor, sold for a one-time passing fee).

1. Acceptance of These Terms

  • “HIXIUS,” “we,” and “us” mean the HIXIUS business, operated by its founder (“Mike Lex”) from Portugal. When a company is registered, these Terms will be updated with its details, and your existing purchases and guarantees carry over unchanged. Contact: support@hixius.com.
  • By creating an account, starting a trial, or making a purchase, you accept these Terms, the Refund Policy, and the Privacy Policy. Some HIXIUS Expert Advisors may ask you to confirm acceptance before the EA is allowed to trade.
  • You must be at least 18 years old and legally able to enter into contracts.
  • Product-specific terms are labeled by product. A term about one product never applies to the other.

2. What HIXIUS Provides

2.1 HIXIUS (original EA). An automated trading Expert Advisor for MetaTrader 4 and MetaTrader 5, provided under subscription plans with free trials, license keys, official preset files, a customer dashboard, and support.

2.2 HIXIUS GOLD. A functional software service: an Expert Advisor for MetaTrader 5 engineered to trade the evaluation phases of a prop-firm challenge at one supported trading firm and to stop when the account reaches funded status.

  • It trades challenge (evaluation) accounts only, which run on the firm’s simulated capital.
  • It never trades funded accounts or personal real-money accounts.
  • It is engineered for the supported firm’s rule set only and is not sold for use anywhere else.
  • It is sold with the Pass or Refund guarantee, defined exclusively in the Refund Policy: if the software does not pass your challenge, your HIXIUS passing fee is refunded. The firm’s challenge fee is never refunded by HIXIUS.
  • 2.3 What neither product is: financial, investment, legal, or tax advice; a brokerage, deposit, or money-management service; or a trading challenge. HIXIUS GOLD is not an education product — it is working software — and the free content on our sites is general information, not advice.

3. Account, License, and Access Rules

  • One dashboard account per customer. You sign in with your email; keep your login, license keys, activation tokens, and preset files secure. You are responsible for activity under your account.
  • Licenses for both products are personal, non-transferable, and non-exclusive. Do not share, resell, lease, sublicense, publish, or distribute license keys, preset files, or the software.
  • Do not copy, decompile, disassemble, or reverse engineer the software, extract its strategy or hidden parameters, or build competing products from it.
  • HIXIUS GOLD license scope: one passing fee (or one pass credit) licenses one challenge account. Running additional accounts requires additional passes or a pack — there is no limit on how many challenge accounts you may run at the same time. If a challenge fails, your remedy options are in the Refund Policy (refund or a free retry pass).
  • We may suspend license keys showing sharing or abuse patterns (see Section 13).

4. Plans, Trials, Subscriptions, and HIXIUS GOLD Purchases

4.1 Original HIXIUS. Subscription plans billed through Stripe. Free trials, when offered, are temporary and expire automatically. Subscriptions renew per the billing cycle chosen at checkout unless canceled; plan changes follow the rules shown at the time of the request. Cancellation and the 14-Day Functional Guarantee are governed by the Refund Policy.

4.2 HIXIUS GOLD. A one-time passing fee per challenge account. The fee depends on account size ($5,000–$500,000) and challenge type: currently €49–€899 for 1-Step and €59–€1,099 for 2-Step. The exact price is shown at checkout. No subscription, no renewal.

4.3 Multi-pass packs. 3-Pass and 5-Pass packs, purchased from the dashboard, produce prepaid pass credits locked to the account size and challenge type purchased.

4.4 Payments. All payments are processed by Stripe. Prices may change, but a change never affects a fee you already paid.

4.5 Refunds. All refunds — including the HIXIUS GOLD Pass or Refund guarantee — are governed exclusively by the Refund Policy. Scope reminder: the guarantee refunds the HIXIUS passing fee only; it never includes fees paid to the trading firm or any other third party.

5. Trading Responsibility

  • Trading leveraged products is high-risk. Nothing we sell removes market risk or promises profit. Automated trading can create losses quickly during volatile markets, news events, platform errors, VPS outages, broker execution issues, spread widening, or incorrect setup.
  • Your challenge account is a contract between you and the trading firm: you buy it directly from the firm, the firm’s own terms govern it, and the firm alone decides rule breaches, funded status, and payouts.
  • You are responsible for complying with the firm’s terms, and for everything that happens on any funded or personal account — HIXIUS GOLD does not trade those, by design.
  • You are responsible for the legality of using automated trading software where you live, and for your taxes.

6. Performance Information

  • Challenge accounts run on simulated capital, so every challenge-account result we display — dashboard statistics, myfxbook challenge trackers, the Telegram proof channel — is a simulated-account record of a specific account under specific conditions.
  • Our funded-account tracker is different: it shows an account operating under the firm’s funded program, on capital the firm provides, with payouts governed by the firm’s terms. It is labeled separately from challenge results.
  • Past performance, simulated performance, and backtested performance do not guarantee future results. Your account can perform differently.
  • CFTC Rule 4.41 / NFA Rule 2-29-style hypothetical-performance limitations apply to all displayed results; the full text is in the Legal Disclaimer on the HIXIUS GOLD site.
  • No statement on our sites promises profits, funding, or payouts. The only guarantees are the commercial guarantees in the Refund Policy.

7. Support and Setup

7.1 Original HIXIUS. Support at support@hixius.com and via Discord. An optional Done-With-You setup add-on is available at purchase. Support does not include financial advice, broker recommendations, or custom strategy development.

7.2 HIXIUS GOLD setup. You install it yourself in about 5 minutes on MetaTrader 5, following the setup guide: enter your license key and allow the HIXIUS WebRequest URL. Support is available by Telegram direct message, Discord ticket from your dashboard, or email support@hixius.com.

7.3 Uptime is your responsibility. The machine running MetaTrader 5 must stay on and connected while your challenge runs. We recommend a VPS; you choose, purchase, and manage it. HIXIUS is not responsible for missed trades caused by your machine, VPS, internet connection, or MT5 terminal being off or disconnected. See the Refund Policy for how operating conditions relate to the guarantee.

8. Intellectual Property

  • HIXIUS owns the software (both products), trading logic, preset files, site content, branding, and documentation. A license grants the usage rights described in these Terms — not ownership.
  • Feedback you send may be used to improve our products without obligation to you.
  • Third-party names and marks (MetaTrader/MetaQuotes, Stripe, Discord, Telegram, myfxbook, and others) belong to their owners; no affiliation or endorsement is implied.

9. Disclaimers and Limitation of Liability

  • Except for the express guarantees in the Refund Policy (the HIXIUS GOLD Pass or Refund guarantee and the original product’s 14-Day Functional Guarantee), the software and sites are provided “as is” and “as available.”
  • Your sole remedy for a HIXIUS GOLD challenge that does not pass is the Pass or Refund guarantee, as defined in the Refund Policy.
  • To the maximum extent permitted by law, we are not liable for: trading losses; trading-firm decisions (rule changes, suspensions, funding or payout denials); outages of your machine, VPS, internet, MetaTrader, or third-party services; indirect, incidental, or consequential damages; or lost profits or payouts.
  • Where liability cannot be excluded, our total liability is capped at the amount you paid HIXIUS for the purchase concerned (for subscriptions, the fees paid in the 12 months before the event).
  • We are not liable for delays or failures caused by events beyond our reasonable control (force majeure).
  • Nothing in this section limits consumer rights that cannot be waived by contract.

10. Changes to These Terms

  • We may update these Terms; the “last updated” date changes when we do.
  • Material changes are announced on the site or dashboard. Continued use after the effective date means acceptance; if you disagree, stop using the products (your Refund Policy and statutory rights are unaffected).
  • A change never retroactively rewrites a guarantee attached to a fee you already paid.

11. HIXIUS GOLD: Relationship with the Trading Firm

  • HIXIUS is an independent software provider. We are not a proprietary trading firm, and we do not operate, own, or control the challenge.
  • HIXIUS GOLD supports one trading firm’s rule set. The supported firm is not named publicly: it is disclosed to you during onboarding, and before purchase on request through any support channel. These Terms deliberately do not name it.
  • You purchase the challenge directly from the firm, at the firm’s price, under the firm’s terms. The challenge fee is paid to the firm, not to HIXIUS, and HIXIUS never refunds it. HIXIUS receives no referral or affiliate compensation from the firm.
  • The firm alone decides rule compliance, account status, funding, and payouts. HIXIUS cannot reverse or influence those decisions.
  • If the firm changes its rules while your challenge is running, the guarantee is unchanged: it still turns on whether your challenge passes or fails under the conditions in the Refund Policy.

12. HIXIUS GOLD: Monitoring and Recorded Trades

  • From installation, the EA connects to HIXIUS through MetaTrader 5’s WebRequest, and every trade on the challenge account is recorded by HIXIUS monitoring. Your dashboard shows the account’s status.
  • Monitoring is used to operate the service, provide support, and verify Pass or Refund claims. Public proof of performance (myfxbook tracking and the Telegram proof channel) uses HIXIUS-run accounts only — your customer account data is never published. Details are in the Privacy Policy.
  • Active monitoring is a condition of the Pass or Refund guarantee (Refund Policy, Section 10) — recorded trades are how claims are verified.

13. Acceptable Use and Termination

Do not:

  • run HIXIUS GOLD on account types it is not sold for — funded accounts, personal real-money accounts, or challenges at unsupported firms;
  • misrepresent facts to HIXIUS or to the trading firm (identity, eligibility, account details) in connection with the software or a guarantee claim;
  • interfere with monitoring or license validation, or tamper with the EA;
  • share, resell, or reverse engineer in breach of Section 3;
  • submit false refund claims or abusive payment disputes (Refund Policy, Section 13).
  • Honest reviews — positive or negative — are welcome; we only ask that statements of fact be true.
  • On material breach, we may suspend or terminate licenses and dashboard accounts. Termination for breach does not create refund rights beyond the Refund Policy and your statutory rights.
  • If HIXIUS GOLD is ever discontinued, guarantees attached to running challenges are honored in full; anything beyond that remains governed by the Refund Policy and your statutory rights.

14. Governing Law and Disputes

  • These Terms are governed by the laws of Portugal, and disputes belong to the competent Portuguese courts, without prejudice to mandatory consumer protections of your country of residence.
  • Before any formal step, contact support — most issues are resolved within days.
  • Consumers keep any right to sue or be sued in their home courts where the law provides it.
